Do Not Sell or Share My Personal Information

1. Your Right to Opt Out

CnergyPro Global Solutions LLC ("CnergyPro," "we," "us," or "our") respects your privacy and your right to control how your personal information is used. This page is provided in compliance with the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), the Texas Data Privacy and Security Act (TDPSA), and other applicable state privacy laws that grant consumers the right to opt out of the "sale" or "sharing" of their personal information.

Under these laws, "sale" is broadly defined and may include the exchange of personal information for monetary or other valuable consideration. "Sharing" refers to making personal information available to third parties for cross-context behavioral advertising purposes, whether or not for monetary consideration.

2. CnergyPro's Practices

CnergyPro does not sell your personal information in the traditional sense of the word -- we do not exchange your personal data for monetary compensation. However, in the interest of full transparency and to ensure comprehensive compliance with the broad definitions under applicable state privacy laws, we provide this opt-out mechanism.

Like many businesses, our Site may use cookies, pixels, tags, and similar tracking technologies provided by third parties (such as analytics and advertising platforms) that may constitute "sharing" of personal information under certain state privacy laws. This may include:

  • Identifiers such as cookies, IP addresses, and device identifiers shared with analytics providers.
  • Internet or other electronic network activity information, such as browsing history and search history on our Site, shared with advertising networks.
  • Inferences drawn from the above information to create a profile about you, which may be used for targeted advertising.

3.1 Online Request

Submit an opt-out request through the contact form, choosing "A privacy or data request" and writing "Do Not Sell or Share My Personal Information." Please include your full name, email address, and any additional information that will help us identify and process your request.

3.2 Cookie and Tracking Opt-Out

You can opt out of third-party tracking cookies and similar technologies by:

  • Adjusting your browser settings to block or delete third-party cookies.
  • Using the opt-out tools provided by the Digital Advertising Alliance at https://optout.aboutads.info.
  • Using the Network Advertising Initiative opt-out tool at https://optout.networkadvertising.org.
  • Enabling the Global Privacy Control (GPC) signal in your browser. We honor GPC signals as a valid opt-out request where required by applicable law.

3.3 Global Privacy Control (GPC)

We recognize and honor the Global Privacy Control (GPC) signal as a valid method to opt out of the sale or sharing of personal information, as required by the CCPA/CPRA and other applicable state laws. When we detect a GPC signal from your browser, we will treat it as a request to opt out of the sale or sharing of personal information associated with that browser. 4. Applicable State Privacy Laws

This page is provided in compliance with, and your rights may be governed by, the following state privacy laws (as applicable based on your state of residence):

  • California (CCPA/CPRA): Cal. Civ. Code sections 1798.100-1798.199.100. California residents have the right to opt out of the sale or sharing of personal information.
  • Texas (TDPSA): Texas Business and Commerce Code, Chapter 541. Texas residents have the right to opt out of the processing of personal data for targeted advertising and the sale of personal data.
  • Virginia (VCDPA): Va. Code sections 59.1-575-59.1-585. Virginia residents have the right to opt out of the sale of personal data and targeted advertising.
  • Colorado (CPA): Colo. Rev. Stat. sections 6-1-1301-6-1-1313. Colorado residents have the right to opt out of the sale of personal data and targeted advertising.
  • Connecticut (CTDPA): Conn. Gen. Stat. sections 42-515-42-525. Connecticut residents have the right to opt out of the sale of personal data and targeted advertising.
  • Oregon (OCPA): Oregon Consumer Privacy Act. Oregon residents have the right to opt out of the sale of personal data and targeted advertising.
  • Montana (MCDPA): Montana Consumer Data Privacy Act. Montana residents have the right to opt out of the sale of personal data and targeted advertising.
  • Utah (UCPA): Utah Consumer Privacy Act. Utah residents have the right to opt out of the sale of personal data and targeted advertising.
  • Other States: If you reside in a state with a comprehensive privacy law that includes opt-out rights for the sale or sharing of personal information, we will honor your request in accordance with applicable law.

5. Categories of Personal Information

The following categories of personal information may be involved in activities that could constitute a "sale" or "sharing" under applicable state privacy laws:

  • Identifiers: Such as IP address, cookie identifiers, and device identifiers.
  • Internet Activity: Browsing history, search history, and information regarding your interactions with our Site.
  • Geolocation Data: Approximate location derived from your IP address.
  • Inferences: Profiles created from the above data reflecting preferences, behavior, and interests.

6. Verification Process

When you submit an opt-out request, we may need to verify your identity to ensure we are processing the correct request. We will attempt to verify your identity by matching the information you provide with information we already have on file. We will not require you to create an account solely for the purpose of verifying your request. If we cannot verify your identity, we may request additional information from you.

7. Authorized Agents

You may designate an authorized agent to submit an opt-out request on your behalf. If an authorized agent submits a request, we may require: (a) signed written authorization from you designating the agent; (b) verification of the agent's identity; and (c) direct confirmation from you that you authorized the agent to act on your behalf. We may deny a request from an agent who does not submit proof that they have been authorized to act on your behalf.

8. Non-Discrimination

CnergyPro will not discriminate against you for exercising your privacy rights. We will not deny you goods or services, charge you different prices, provide a different level or quality of services, or suggest that you may receive a different price or level of service for exercising your opt-out rights under applicable law.

9. Response Timeframe

We will process your opt-out request within 15 business days of receipt, as required by the CCPA/CPRA. For requests under other state privacy laws, we will comply with the applicable response timeframe. We will notify you if we need additional time to process your request. Once processed, your opt-out preference will remain in effect unless and until you subsequently provide express authorization for the sale or sharing of your personal information.

10. Minors

We do not knowingly sell or share the personal information of consumers under the age of 16. If we have actual knowledge that a consumer is between the ages of 13 and 16, we will not sell or share their personal information without their affirmative authorization. If we have actual knowledge that a consumer is under the age of 13, we will not sell or share their personal information without the affirmative authorization of the consumer's parent or guardian.

11. Changes to This Page

We may update this page from time to time to reflect changes in our practices or applicable laws. When we make changes, we will update the "Effective Date" at the top of this page.
